NOTICE OF U.S. MARSHAL’S SALE

Pursuant to the Judgment Entry of Foreclosure and Order of Sale entered in the action entitled United States of America v. Donna Holman, et al., Case No. 3:16cv02611 pending before the United States District Court for the Northern District of Ohio, Western Division, the United States Marshal will set a public sale on the steps of the Van Wert County Courthouse, 121 East Main Street, Van Wert, Ohio on July 7, 2017, at 1:00 p.m., the property directed therein to be sold and described as follows: Commencing at the intersection of the center line of U.S. Route 30, as originally located and the East line of the West half of the Southeast Quarter of Section Ten (10), Town Two (2), Range Two (2) East, Pleasant Township, Van Wert County, Ohio; thence in a North- westerly direction along the center line of Route 30, Nine Hundred Eighty-seven (987) feet to

the place of beginning; thence North Three Hundred Thirty and Forty Hundredths (330.40) feet to an iron pin; thence in a Northwesterly direction parallel with the center line of Route 30, One Hundred Twenty (120) feet to an iron pin; thence South Three Hundred Thirty and Forty Hundred (330.40) feet to the center line of Route 30; thence in a Southeasterly direction along

the center line of Route 30, One Hundred Twenty (120) feet to the place of beginning, containing Ninety-one Hundred (.91) of an acre. More commonly known as 10585 Lincoln Highway, Van Wert, Ohio 45891.

1. The purchaser, as soon as the bid is accepted, shall be required to deposit with the

United States Marshal, in United States currency or by certified check payable to the Clerk of the United States District Court for the Northern District of Ohio, 10% of the amount of the accepted bid. Where the amount is $3,000.00 or less, the minimum amount of a deposit shall be $300.00.

The maximum amount of a deposit in any case shall be $10,000.00. If such deposit is not so tendered forthwith, the Marshal shall reopen the bidding immediately, starting with the next highest bid, if still available, and continue until a sale is made to a bidder who meets the deposit requirements set forth herein.

2. The unpaid balance of the purchase price shall be due and payable to the United

States Marshal within 30 days from the date of sale in United States currency or a certified check payable to the Clerk of the United States District Court for the Northern District of Ohio.

3. A purchaser who fails to pay the entire purchase price to the United States

Marshal as provided herein within said 30 days after the date of sale, may be found in contempt of this Court and the deposit made shall be forfeited and included in the proceeds of the sale to be distributed as determined by further order of this Court. The subject property shall be reoffered for sale at said purchaser’s expense.
